RELEASE, HOLD HARMLESS AND INDEMNITY
Little Traverse Conservancy, Inc. (LTC) allows hunting on its land only if the applicant assumes all liability arising from such activity. Therefore, in consideration of permission to hunt on the LTC land described below, the undersigned applicant (Applicant) hereby releases LTC, holds LTC harmless, and indemnifies LTC from any liability arising and in any way related to Applicant’s activity, including any negligence, resulting in property damage, personal injury or death in respect of the Applicant, trustees, officers, employees, agents, volunteers, or members of LTC, or third parties. Applicant shall also pay any costs incurred by LTC in defending any claims arising from Applicant’s activity, including actual attorney fees. Applicant acknowledges that hunting is an inherently dangerous activity and that both hunting, and conditions which may exist on land, can pose a risk of property damage, serious injury or death. The Applicant shall have no authority to grant others the permission to hunt. LTC may,without notice, grant others permission to hunt the land described below during the same period as permission may be granted to Applicant.
Applicant forfeits any rights to any items left on LTC Land after the season, and Applicant shall reimburse LTC for any costs it may incur disposing of any materials left by Applicant on LTC land or restoring any land or vegetation disturbed by Applicant.
